These Terms and Conditions ("Terms") apply when you visit www.backpocketmarketing.com or any of our pages on get.backpocketmarketing.com, join our email list, buy a digital product, attend a workshop, or work with Back Pocket Marketing Studio ("we," "us," or "our"). By using our website, submitting a form, or making a purchase, you agree to these Terms.

1. Using Our Website and Pages

You may use our website and pages for your own personal and business purposes. You agree not to:

• Use our site in a way that breaks any law or harms our systems or other visitors
• Submit false information through our forms, or sign someone else up without their consent
• Try to access paid content, portals, or accounts you have not purchased or been given access to

We may update, change, or remove any part of our website at any time.

2. Email Messages

When you join our email list, download a free resource, or join a waitlist, you agree to receive emails from Back Pocket Marketing Studio. These may include the resource you asked for, helpful content, and offers for our products and services. Every marketing email includes an unsubscribe link, and you can opt out at any time. If you buy something, we may still send emails about your purchase, like receipts, access details, and delivery updates.

3. Text Messages

If you give us your mobile number and agree to receive text messages, you may get messages about your purchase, appointments, and offers from Back Pocket Marketing Studio. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Agreeing to receive texts is never required to make a purchase. We do not sell or share your mobile number or text opt-in consent with third parties for their marketing.

4. Digital Products

What You Get

Our digital products include planners, templates, prompts, workbooks, guides, and recorded workshops. Each product page describes what is included. Most digital products are delivered instantly by email or through a member portal. If a product has a later delivery date, like a recorded workshop, the product page will list that date, and we will deliver it by then.

Your License

When you buy a digital product, you get a personal, non-transferable license to use it for yourself and your own business. You may not:

• Share, resell, give away, or post the product, your login, or your download links
• Use the product to create a competing product or course
• Remove our name or copyright notices from the materials
• Use the product for clients or other businesses unless the product page says that use is included

AI Prompts and Tools

Some products include prompts made for AI tools like Claude or ChatGPT. Those tools are run by third parties and have their own terms, fees, and privacy practices. AI tools can make mistakes, so please review everything they produce before you publish or send it. You own the content you create with our prompts, and you are responsible for how you use it.

5. Services and Coaching

Our services include marketing strategy, consulting, coaching (including voice-message coaching), and done-with-you or done-for-you work. Each service has its own proposal, agreement, or sales page that lists what is included, the timeline, and the payment terms. If that agreement says something different from these Terms, the agreement wins.

Coaching and consulting give you guidance, feedback, and our professional opinion. You make the final decisions for your business and are responsible for the results of those decisions.

6. Payments

All prices are listed in US dollars. Payments are processed securely by our third-party payment processor, and we do not store your card details. By purchasing, you confirm you are authorized to use the payment method you provide.

If you choose a payment plan, you agree to pay every installment on schedule, even if you stop using the product or service. If a payment fails and is not resolved within 7 days, we may pause your access until your account is current.

7. Refunds

Because digital products give you instant access to everything, all sales of digital products, planners, prompts, templates, and recorded workshops are final. We do not offer refunds or exchanges on these purchases.

Refunds for services and coaching follow the terms in that service's agreement. If something is wrong with your purchase, like a broken link or missing file, email [email protected] and we will fix it.

Please contact us before filing a chargeback so we can resolve the issue. Filing a chargeback for a product or service you received may end your access.

8. Intellectual Property

Everything on our website and in our products, including text, graphics, photos, videos, prompts, templates, and frameworks like the DENIM Method™ and the GCR System, belongs to Back Pocket Marketing Studio or is used with permission. It is protected by copyright and trademark laws. Buying a product gives you a license to use it as described in Section 4, not ownership of the materials.

You keep ownership of anything you share with us, like your business information, copy, or plan. You give us permission to use it only to deliver the product or service you purchased.

9. No Guarantee of Results

We share strategies, examples, and numbers to help you make better marketing decisions. Your results depend on your offer, your audience, your effort, the market, and many other things we do not control. We do not promise or guarantee any particular income, sales, list growth, or other results. Any examples we share are not a promise of what you will get.

Our content is for education and general business guidance. It is not legal, tax, financial, or accounting advice. Please talk with a qualified professional about those questions.

10. Third-Party Tools and Links

We use third-party platforms to run our business, including GoHighLevel, our payment processor, and messaging apps like Voxer. Our products may also mention or link to outside tools and websites. We are not responsible for those third parties, their content, their availability, or their terms, and your use of them is governed by their own policies.

11. Respectful Use

If you join a coaching program, group, or community with us, please treat everyone with respect. We may remove access, without a refund, for anyone who harasses others, shares other members' information, or shares program materials outside the program.

12. Limitation of Liability

Our website, products, and services are provided "as is." To the fullest extent allowed by law, Back Pocket Marketing Studio is not liable for any indirect, incidental, or consequential damages, including lost profits or lost data, that come from your use of our website, products, or services. If we are found liable for anything, our total liability is limited to the amount you paid us for the product or service in question during the 12 months before the claim.

13. Indemnification

You agree to protect Back Pocket Marketing Studio from claims, losses, or costs, including reasonable legal fees, that come from your breach of these Terms or from how you use our products, prompts, or the content you create with them.

14. Governing Law and Disputes
